According to PEOPLE, the driver of the Tesla, Dharmesh Arvind Patel, that plunged 250 feet down a notorious California cliff on January 2 while carrying his family with him has been charged with attempted murder.

Dharmesh Arvind Patel, 40, was charged with three counts of attempted murder in connection with the collision that involved his 41-year-old wife, and his two kids - a 7-year-old girl and a 4-year-old boy. According to San Mateo County Superior Court records examined by PEOPLE, two of the counts carry enhancements for domestic violence, substantial bodily injury, serious felony, and prior felony. In addition, enhancements of serious felony and prior felony are included in the third count.

he accident happened on the infamous Devil's Slide, a section of Highway 1 that follows the entire length of California's coastline, in San Mateo County, close to Pacifica. Over the previous fifty years, a number of fatalities have occurred at the Devil's Slide.

Additionally, after speaking with witnesses and gathering data at the scene of the collision, the California Highway Patrol reported that "investigators developed probable cause to believe this incident was an intentional act." According to an arrest report provided to PEOPLE by the California Highway Patrol, Dharmesh Arvind Patel, the driver, was detained following the collision at Stanford Hospital.

In a press release, the CHP stated that on January 2, at approximately 10:50 a.m. local time, it received a report of "a vehicle over the side of the cliff on SR-1." According to the press release, when the CHP and other responding authorities arrived on the scene, they discovered a white Tesla that had plunged 250–300 feet over the cliff. The family was located in the car by authorities, who then took them "to a local hospital with serious injuries."

According to Coastside Fire Protection District/Cal Fire battalion chief Brian Pottenger, it was an "absolute miracle" that all of the passengers survived. The car, revealed Pottenger, came to rest on its wheels in the sand.

Moreover, Pottenger claimed that when they first arrived, officials had no idea how many individuals were inside, but they could see "movement in the front seat." He continued, "We knew we had at least one person that was alive. We were actually very shocked."
Authorities "come out here unfortunately all too often for things like this," Pottenger said while speaking at the site. He claimed, "They never live. This was an absolute miracle."
