According to court records, on August 5, 1999, an executive entering Ferguson Enterprises in Pelham heard sounds and watched Miller, a delivery driver, leave before discovering Lee Holdbrooks and Scott Yancy dead inside. Miller then drove off, only to reappear a short distance away at Post Airgas, where Terry Jarvis had been killed and where Miller had previously worked.

Miller, according to the testimony, was delusional and thought the guys were spreading stories about him, including one by Jarvis that he was gay. A defence psychiatrist testified that Miller suffered from mental illness, but that it did not rise to the level required for an insanity defence in the state of Texas.
