Microsoft States FTC Breaks The Constitution By preventing Activision Blizzard Acquisition

Microsoft claims that the FTC is infringing on its fifth amendment due process rights. They also claim that they are "merely two of hundreds of game publishers". This is just one of many reasons why Microsoft believes the deal should be finalized. According to the FTC, the agreement will harm competition by restricting access to Call of Duty and other well-known video game franchises. Microsoft claims that it intends to expand its visibility in mobile gaming, a market that the FTC does not think is relevant. "A single game acquisition by the third-place console producer cannot upend a super competitive industry," Microsoft responds. "This is especially true when the manufacturer has stated unequivocally that it will not withhold the game." Xbox

Activision is one of the world's top video game developers, creating and publishing high-quality video games for a variety of platforms. It is responsible for some of the most well-known and popular video game franchises, including Call of Duty, World of Warcraft, Diablo, and Overwatch. Activision currently offers its games on a wide range of devices, regardless of manufacturer, but this could start changing if the deal is completed. It's unclear whether the $69 billion deal will be completed or whether Microsoft's claim of unconstitutional actions may have any impact on the FTC's intention to block it.
