Authorities say a 19-year-old Louisiana State University student was fatally struck by a car shortly after reportedly being raped by at least two men and left to wander the streets. According to officials, four suspects have been accused in relation to the East Baton Rouge incident on January 15 that took place before LSU student Madison Brooks passed away. Furthermore, according to probable cause affidavits that PEOPLE acquired, Kaivon Washington, 18, and a 17-year-old minor are each accused of one count of third-degree rape. And Casen Carver, 18, and Everett Lee, 28, are each accused of one count of principal to third-degree rape.

Details about the case

The affidavit states that when LSU student Madison Brooks left Reggie's Bar on Bob Pettit Boulevard, close to the LSU campus, in the early hours of January 15, her blood alcohol level was close to four times the legal limit. Apparently, she also tested positive for THC. According to the affidavit, Carver admitted to the police that he didn't know Brooks and had never seen her before. He claimed that as they were "leaving the bar for the night, the victim walked with them," according to the affidavit. Furthermore, Carver described Brooks as "very unstable on her feet," unable "to keep her balance," and "unable to speak clearly without slurring her words." According to the affidavit, Brooks can be seen falling inside the pub on a video. According to the report, Carver claimed to have seen Brooks and the 17-year-old guy "hugging and walking together" and that she had requested a lift home. Also read: Who is William F Tate? More details

Carver claimed he parked the vehicle on an adjacent street and claimed to have heard the 17-year-old ask Brooks "five times" if she wanted to have intercourse with him, and the affidavit stated that "the victim gave verbal consent to her 17-year-old friend." According to the affidavit, Brooks and the 17-year-old had sex in the backseat of the vehicle. The affidavit stated that after the 17-year-old had sex with Brooks, Carver claimed to have overheard Washington asking the girl "numerous times" if she wanted to have sex with him, and that "she consented." Moreover, Carver claimed that while "sex acts were being performed with the victim," he and Washington's uncle Lee remained in the front seat. Additionally, the affidavit claimed that Carver informed officials that Washington and Brooks stopped having sex after he said, "we got to stop this," at some time. Furthermore, Carver answered, "I guess," when asked if Brooks was too incapacitated to consent to intercourse, according to the affidavit. He claimed that he left Brooks "in a subdivision" because he was unable to discover her residence. But no arrest was made for the driver. Lastly, according to Joe Long, Carver's attorney, Brooks' passing is "a tragedy, but not a crime." And according to Washington and Lee's attorney Ron Haley, this was "absolutely not a rape."
