According to the Feed on Instagram and Ars Technica's records, Kris Kashtanova, a New York artist, received US copyright registration in what may be noted as the first of this sort for the graphic novel featuring artwork generated by AI.
The artist wrote, "I got Copyright from the Copyright Office of the USA on my Ai-generated graphic novel. I was open to how it was made and put Midjourney on the cover page. It wasn't altered in any other way. Just the way you saw it here."
"I tried to make a case that we own Copyright when we make something using AI. So I registered it as a visual arts work. My certificate is in the mail, and I got the number and a confirmation today that it was approved." "My friend's lawyer gave me this idea, and I decided to make a precedent."
The registration, effective from September 15th, applies to a comic called Zarya of the Dawn. The artist created the artwork using a commercial image synthesis service called Midojurney.
Kashtanova stated that the artwork was created with the help of AI but not entirely; the artist wrote the story, made a layout, and pieced the images together using their artistic ability. It is rare for artists to register their works created by machines.
The history of art dates back to 1960, but this is the first time an artist has registered a copyright for their work powered by latent diffusion, which is being debated among artists. Guesstimate about AI artwork being copyrighted has been the subject of discussion for the past few months.
Getty images banned images created by using AI on its platform because of copyrights and ethics issues. The US Copyright Office has yet to absolve copyrights to AI-created artwork entirely but ruled out registering the Copyright to AI as the creator in place of a human.
The main character in the Zarya of the Dawn resembles Zendaya, a Hollywood actress, and is available freely on the website of AI comic books.
